Terms and Conditions

• All terms of the contract between the Purchaser and the Company are in this document. No representations or warranties are made or given by the Company save as appear herein and in particular no guarantee or waranty is given that the installation will reduce, eliminate or be free from condensation. No variation of or addition to the work specified in the Schedule overleaf shall have effect unless agreed in writing under the signature of a duly authorised officer of the Company.

• The purchaser shall grant the Company's employees access to the premises at reasonable times for the purpose of taking measurements and of carrying out the work specified.

• The balance on completion referred to overleaf shall be paid to the Company upon delivery, or upon fixing of the installation being completed where fixing is part of the Contract, Payment shall be in cash or by way of a cheque or money order payable to Profile Window Systems and crossed A/C Payee only, Any variation in the applicable rate of VAT or where no VAT is shown overleaf as chargeable, any imposition of VAT after the date of the order overleaf will be passed to the purchaser.

• Representatives and showroom samples are used to demonstrate a typical window and its composition. Windows and doors shown in the schedule overleaf will be measured and manufactured in the way considered most suitable by the Company. Due to its policy of continuous improvement the Company reserves the right to alter specifications and make necessary modifications without prior notice, provided that such alterations and modifcations do not substantially alter the subject matter of the contract.

• The Company guarantees to repair or replace free of charge any unit supplied and installed by it which proves defective as a result of faulty materials or workmanship within five years from the date of installation, and the Company's formal written guarantee will be sent to the Purchaser upon receipt of the balance payable on completion. The Purchaser;s attention is however drawn to the part that the Company accepts no liability for the maintnance of any timber used in the installation.

• We will make every effort to complete the work on time (or if no date has been agreed, within a reasonable time from the date of your order) but we cannot be held responsible for delays due to weather or other circumstances beyond our control.In this case we will complete the work as soon as reasonably possible.

• In the event that the Purchaser insists against the Company's advice on ordering a glazed installation of a sixe or style which results in the Company's recommended maximum size for a particular area of glass being exceeded (and this fact is noted on the order overleaf) the Company shall not be responsible for any risk or potential adverse consequences involved and the Company's above mentioned guarantee shall not apply to any defect which is the result of the installation of an oversize unit.

• The Company will make good any damage caused in the course of installation to plaster, floor, rendering or brickwork immediately surrounding any window or door installed but does not undertake to provide matching ceramic or other tiles or specialised finishes such as tyrolean or pebble-dash or to avoid damage to surrounding wallpaper or paintwork or to remove intact any panes of glass or fames from old windows required to be retained by the Purchaser. Any claim by the Purchaser for compensation for damage caused by the Company through our negligence must be notified to the Company as soon as practicable after the damage is discovered. Where we agree to such a claim, we will make good or offer compensation or pass details to our insurers.

• All glass used is the best commercially obtainable but the Company cannot guarantee against any imperfection or variation in the glass making process. Our Company complies with the visual standard of the Glass and Glazing Federation of which our Company is a member.

• Upon the signing by the Purchaser and a duly authorised representative of the Company of the form of acceptance overleaf a binding contract will be created in respect of the order, details of which are given overleaf.The Company reserves the right to cancel any order by refunding all monies paid upon receipt of an unsatisfactory survey report from its Surveyor or in the event of unsatisfactory credit references being obtained in repect of the Purchaser.

These terms and conditions shall not be construed as to effect the staturtory or common law rights of the purchaser. Title and ownership of these goods do not pass to the purchaser until full payment has been received.
